CCPC issues guidance on new price reduction obligations for Irish businesses from November 2022 (assets.ccpc.ie)
- New obligations apply from 28 November 2022 to all businesses selling goods to EU consumers in Ireland.
- Prior price must be the lowest price applied in the 30 calendar days before the reduction.
- Successive reductions in same campaign use the lowest price before the first reduction as prior price.
- General announcements like '20% off everything' need prior price on individual price tags but not in the announcement itself.
- Exemptions include loyalty programmes, personalised discounts, and buy-one-get-one-free offers.
"The Competition and Consumer Protection Commission (CCPC) has published guidance for businesses selling goods in Ireland on new legal requirements for price reduction announcements, effective 28 November 2022. Under the European Union (Requirements to Indicate Product Prices) (Amendment) Regulations 2022, businesses must display the prior price – the lowest price applied in the previous 30 days – when announcing a reduction. The guidance covers calculation of prior price, successive reductions, general price reduction announcements, group advertising, and exemptions for loyalty programmes. Non-compliance may lead to enforcement action including fines. The CCPC strongly advises retaining pricing records."
